Opinion: The Weakness of Trump’s Defense in the Hush-Money Trial

In the high-stakes legal battle over hush-money payments to adult film actress Stormy Daniels, former President Donald Trump’s defense team has employed a strategic approach aimed at humanizing him. By highlighting his roles as a father and husband, they aim to influence the jury’s opinion by demonstrating that he was attempting to shield his family from the scandal. However, upon closer examination, it becomes evident that this defense is fraught with challenges and lacks credibility.


Before evaluating Donald Trump as an ordinary husband and family man, it’s crucial to take into account his distinctive personality and historical context:


  • Narcissistic Tendencies: Trump exhibits traits associated with narcissistic personality disorder. His self-centeredness, need for admiration, and lack of empathy set him apart from the average person. Narcissists prioritize their own interests above all else, including family.

  • Transactional Relationships: Trump’s past behavior reveals a pattern of transactional relationships. He often prioritizes his image, success, and power over personal connections. His interactions lack the depth and emotional investment typical of genuine family bonds.

  • Public Perception: Even his supporters perceive him as having a highly disordered personality. His overall behavior aligns with the criteria for narcissistic personality disorder. This makes it less believable that his primary motivation was protecting his family.



In addition:


  • The Burden of Proof: Trump’s defense lawyers have emphasized the heavy burden of proof on the prosecution, asserting that their client is “innocent” and that “none of this was a crime.” However, legal experts note that defense attorneys typically avoid using the term “innocent” because it requires a factual basis. A “not guilty” verdict, based on the government’s failure to meet its burden of proof, would be more appropriate. Without Trump testifying about his state of mind, the defense faces an uphill battle regarding criminal intent.

  • Michael Cohen’s Unreliability: The defense has focused on attacking Michael Cohen, Trump’s former lawyer, as a key witness. Cohen’s unreliability is central to their strategy, but it remains to be seen whether this tactic will be sufficient. Notably, the defense has not addressed another crucial prosecution witness, Hope Hicks, leaving them vulnerable to her potential testimony.

  • Keith Davidson’s Text Message: During the trial, prosecutor Matthew Colangelo revealed a significant piece of evidence. On election night in 2016, Keith Davidson, the lawyer who brokered the Stormy Daniels deal, texted the National Enquirer’s editor-in-chief, asking, “What have we done?” This message underscores the questionable nature of the hush-money payments and raises doubts about Trump’s involvement.


If convicted, Trump will face legal humiliations he often relishes when applied to others.


In conclusion, Trump’s defense faces significant hurdles. His past actions, combined with the evidence presented, make it challenging for even his staunchest followers to believe in his innocence.
